1. Agreement and who may use Daycare Copilot

By creating an account or using Daycare Copilot (the “Service”) you agree to these Terms and to our Privacy Policy, Refund Policy and AI Disclaimer. If you do not agree, do not use the Service.

You must be at least 18 years old and use the Service for your work in a childcare or early-childhood program. The Service is not for children and children may not have accounts. If you use it for an organization, you confirm you can bind it to these Terms.

2. What the Service is — and is not

Daycare Copilot is a planning aid. It helps you draft weekly activity plans, printable resources and family summaries, mostly with the help of artificial intelligence, and offers optional attendance and family check-in tools. Using the Service requires a paid subscription: you set up your account first and choose a plan before you can plan weeks. Features, limits and plan contents are shown in the app and can change.

The Service is not professional, medical, developmental, legal or safety advice and does not replace your judgment, your training, your licensing rules or your duty to supervise children. See the AI Disclaimer.

3. Your responsibilities as a provider

  • Review everything before you use it. You are responsible for deciding whether an activity, material or image is safe, age-appropriate and suitable for the particular children in your care (including allergies, choking hazards for young children, and special needs) and compliant with your licensing and local rules.
  • Keep your sign-in details secret and tell us promptly about unauthorized access. You are responsible for activity under your account.
  • Give accurate information, and enter information about children only if you have the right to do so, including any parent or guardian permission your program requires.
  • Do not put children's names, health details or other sensitive information into free-text boxes that are used to create resources (those boxes are sent to our AI provider; see the Privacy Policy).

4. Subscriptions, billing and cancellation

  • Paid plans are sold and charged through Hotmart, which handles checkout and payments under its own terms. The price, billing period (monthly or annual), currency, taxes and any promotional conditions are shown on the checkout page before you pay.
  • Subscriptions renew automatically at the end of each billing period until you cancel, and you are charged the price shown at checkout (or the then-current price if we announce a change in advance).
  • You can cancel at any time in your Hotmart buyer account: My purchases → select Daycare Copilot → Configure payment → Cancel your subscription. Cancelling stops future renewals; you keep paid access until the end of the period you already paid for, and cancelling does not by itself refund the current period.
  • Refunds are covered by our Refund Policy. If a payment is refunded or reversed (chargeback), paid access ends immediately.
  • We may offer promotions (for example a founder price). They apply on the conditions shown when you buy.

5. Acceptable use

You agree not to:

  • break the law, or use the Service to harm, exploit, endanger or sexualize any child, or to harass or deceive anyone;
  • upload content you do not have the right to use, or ask for content that copies a third party's characters, brands or protected works;
  • copy, scrape, resell, sublicense or redistribute the Service, its resource library or its content outside the permissions in section 6;
  • probe, bypass or overload our systems, share your account, or avoid usage limits;
  • use the Service or its output to build or train competing AI products, or in ways that break our AI providers' usage policies.

6. Content, ownership and licenses

This section matters. We use three words carefully: ownership (who holds the rights), copyright (a legal protection that exists only where the law recognizes it) and license (permission to use).

6.1 The Service and our materials. Daycare Copilot's software, brand, templates and layouts, curriculum structures, and the resource library as a whole (its selection, organization and compilation) belong to us or our licensors. These Terms give you no ownership of them.

6.2 Resources generated through the Service (“Generated Resources”). Generated Resources are the activities, plans, images, printables, worksheets, visual guides, translations and similar educational content that the Service produces when you use it — including anything produced because of your request. Creating a request does not make you the exclusive owner of what is generated. Daycare Copilot is designed so that generated resources can become part of a reusable resource library.

6.3 What we may do with Generated Resources. You agree that we may store, validate, index, categorize, modify and adapt, version, replace and retire Generated Resources; regenerate derivatives of them; include them in our resource library; offer the same or similar resources to other educators; incorporate them into future plans; and otherwise use them to operate and improve the Service.

6.4 Rights in Generated Resources. Our AI provider's terms currently assign to us, as its customer, whatever rights it holds in output, to the extent the law allows. We do not promise that any copyright or other legal protection exists in AI-generated material — many legal systems give none to material produced without enough human authorship — and we claim copyright only where the law recognizes it (for example in human-written text, our selection and arrangement, templates and branding). Separately, to the extent you acquire any right in a Generated Resource by operation of law, you assign it to us; where that assignment is not effective, you grant us a perpetual, irrevocable (except where the law requires otherwise), worldwide, royalty-free, transferable and sublicensable license to do everything in section 6.3, and you waive moral rights to the extent permitted. Nothing here transfers ownership of your Pre-existing Content (6.7).

6.5 Your license to use Generated Resources. While you have an account in good standing — and for resources you have already printed or shared with families — we grant you a non-exclusive, non-transferable, non-sublicensable license to use Generated Resources and our materials for your own childcare or early-learning program: to display, print, copy and share them with the children and families you serve. You may not sell, publish or redistribute them as a product, or claim that you exclusively own or authored them.

6.6 AI output is not unique. Other educators may receive identical or similar resources, and the AI provider says its output may not be unique either. We cannot promise exclusivity, and we do not intend to give any educator exclusive rights in Generated Resources.

6.7 Your Pre-existing Content. Material you bring to the Service that already existed — for example your daycare logo, your own photograph, documents you wrote, and the information you enter about your program, children and families (“Pre-existing Content”) — stays yours. You grant us a non-exclusive, worldwide, royalty-free license, for as long as the content is in your account (plus the time needed to complete deletion and backup expiry), to host, store, process, reproduce, resize, format, display and transmit it as needed to operate the Service for you — for example to place your logo on your own printables or show a child's name to that child's family on your check-in page. We do not add Pre-existing Content to the shared library and do not use it to train AI models. You confirm that you own it or have all rights and permissions needed to upload it, and that it does not infringe anyone's rights or privacy. Do not upload photos of children.

6.8 Resources that contain your branding or personal details. Resources that carry your logo, your name or children's information are intended to stay private to your account. Our automated checks to keep personal details out of the shared library are not perfect; tell us if something personal appears and we will remove it.

6.9 Third-party rights. AI output can unintentionally resemble existing works. If you believe a resource infringes your rights, write to us and we will review and, where appropriate, remove it.

6.10 Feedback. If you send us ideas or feedback, we may use them without obligation to you.

7. Third-party services

The Service relies on providers such as Hotmart (payments), Supabase and Vercel (infrastructure), OpenAI (AI generation) and Resend (account emails). Their services are governed by their own terms, and we are not responsible for their acts or outages beyond what the law requires.

8. Changes and availability

We may change, add or remove features, set usage limits, and update plan contents. We work to keep the Service available but do not guarantee uninterrupted or error-free operation. We will give notice of material changes that adversely affect a paid plan where practical.

9. Suspension and termination

You may stop using the Service at any time (cancel your subscription as in section 4) and may ask us to delete your account at support@daycarecopilot.com. We may suspend or end access if you breach these Terms, create risk or harm for others or for the Service, fail to pay, or if the law requires. Sections that by their nature should survive (including 6, 10, 11 and 12) survive.

10. Disclaimers

The Service and all Generated Resources are provided “as is” and “as available”, without warranties of any kind to the fullest extent permitted by law, including that they are accurate, complete, safe for every child or situation, suitable for your program, or non-infringing. You use them at your own judgment and risk. Some places do not allow certain disclaimers, so some of these may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data; for harm arising from activities, materials or advice you chose to carry out; or for the acts of third-party providers. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law or any consumer rights that cannot be waived.

12. Your responsibility for your content and use

You are responsible for your Pre-existing Content and for how you use the Service and the Generated Resources. To the extent permitted by law, you will cover losses we suffer from third-party claims caused by your breach of these Terms, your unlawful use, or your Pre-existing Content.

13. Changes to these Terms

We may update these Terms. We will show the new date above, and for material changes we will tell you in the app or by email. If you keep using the Service after the change takes effect, you accept the updated Terms; if you do not accept them, stop using the Service and cancel any subscription.
